BREWTALLY — TERMS AND CONDITIONS

1. Acceptance of Terms

By creating an account or using Brewtally you agree to these Terms and Conditions in full. If you do not agree, do not use the platform. These terms form a legally binding agreement between you (the brewery operator) and Brewtally.

2. Description of Service

Brewtally provides a cloud-based brewery management platform including:

  • Batch lifecycle management
  • Fermentation and BBT monitoring logs
  • Sales and revenue tracking
  • Raw material consumption tracking
  • Automated state excise compliance document generation for Indian states
  • Shift handover logs
  • BrewSheet spreadsheet module
  • AI-powered fermentation recommendations (where enabled)

The platform is designed for use by licensed craft breweries and microbreweries operating within India.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and operating a legally licensed brewery business to use Brewtally.

3.2 Account accuracy

You agree to provide accurate brewery information including your state, excise license number, and FSSAI number. Providing false information may result in incorrect compliance documents which is your responsibility, not Brewtally's.

3.3 Account security

You are responsible for:

  • Keeping your password confidential
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorised access at privacy@brewtally.in

3.4 One brewery per account

Each account is for one brewery location. Multi-location brewery groups require separate accounts per location or an Enterprise plan arrangement.

4. Subscription Plans and Payment

4.1 Plans

  • Free Plan: No charge. Limited to 1 user, 5 batches per month, no compliance documents.
  • Starter Plan: ₹2,999 per month. Up to 3 users, unlimited batches, all compliance documents, email support.
  • Professional Plan: ₹7,999 per month. Up to 10 users, API access, WhatsApp alerts, priority support, data export.
  • Enterprise Plan: ₹24,999 per month. Unlimited users, custom integrations, SLA guarantee, dedicated onboarding.

4.2 Billing

  • Subscription fees are billed monthly in advance
  • Payments processed securely via Razorpay
  • All prices are in Indian Rupees (₹) and inclusive of applicable GST
  • No refunds for partial months

4.3 Non-payment

If payment fails your account will be downgraded to Free plan after a 7-day grace period. Your data is not deleted. Upgrade at any time to restore full access.

4.4 Price changes

We will give 30 days notice of any price increases via email and in-app notice.

5. Acceptable Use

You agree NOT to use Brewtally to:

  • Enter false or fabricated production or sales data for the purpose of excise fraud
  • Attempt to access another brewery's data
  • Reverse engineer or copy the platform
  • Use automated bots or scripts to scrape data
  • Violate any applicable Indian law including the Excise Act, IT Act, or FSSAI regulations
  • Share your account credentials with persons outside your brewery

Violation of these terms will result in immediate account termination without refund.

6. Data Ownership

6.1 Your data belongs to you

All brewery operational data you enter into Brewtally — readings, batches, sales, records — belongs entirely to you. Brewtally is the custodian, not the owner.

6.2 Export at any time

You can export all your data at any time in Excel or CSV format from the BrewSheet page. We will never hold your data hostage.

6.3 Our licence to your data

You grant Brewtally a limited licence to store and process your data solely to provide the service to you. We do not use your operational data for any other purpose.

6.4 Anonymised data

We may use fully anonymised and aggregated industry data (e.g. average fermentation temperatures across Indian breweries) to improve the platform. No brewery can be identified from this data.

7. Intellectual Property

7.1 Brewtally platform

The Brewtally software, design, code, algorithms, excise calculation engine, fermentation kinetics model, and all associated intellectual property are owned by Brewtally. You may not copy, modify, distribute, or create derivative works.

7.2 Your content

Your brewery name, recipes, batch names, and operational processes remain your intellectual property. We make no claim to any of your proprietary brewing knowledge.

8. Compliance Disclaimer

Brewtally automates the calculation and formatting of excise compliance documents based on the data you enter and the state excise rules programmed into the platform.

IMPORTANT
  • Brewtally is a tool to assist compliance — it is NOT a substitute for professional legal or accounting advice
  • Excise rates and rules change with state budgets. While we update the platform regularly, you are responsible for verifying that calculations match the current applicable rates in your state
  • Brewtally is not liable for any penalties, fines, or legal consequences arising from incorrect data entered by you, outdated excise rates not yet updated in our system, or documents submitted without verification
  • Always have your CA or compliance officer review generated documents before official submission to excise authorities

9. Limitation of Liability

To the maximum extent permitted by Indian law:
  • Brewtally is provided "as is" without warranty of any kind
  • We do not guarantee 100% uptime. Our target is 99.5% monthly availability.
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim
  • We are not liable for data loss caused by your own actions, incorrect data entry, or circumstances beyond our control

10. Termination

10.1 By you

You may close your account at any time by emailing privacy@brewtally.in. Your data will be exportable for 30 days after closure.

10.2 By Brewtally

We may suspend or terminate your account immediately if you:

  • Violate these Terms and Conditions
  • Engage in excise fraud using our platform
  • Fail to pay for 30+ days beyond grace period
  • Engage in abusive behaviour toward our team

10.3 Effect of termination

  • Compliance records retained for 7 years as required by Indian excise law
  • All other data deleted within 30 days
  • No refund for unused subscription period

11. Governing Law

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India. Applicable law: Indian Contract Act 1872, IT Act 2000, Consumer Protection Act 2019, and applicable state excise regulations.
